Second rent payment (due on 1 July) - a pro-rata rent payment covering 5 July - 31 July.
Please note this payment falls due before your first rental period has ended, this aligns your account with our standard monthly collection cycle. This will be the first full calendar month of the tenancy and the month in respect of which the 2 week rent waiver is applied. The waiver will first be applied against the pro-rata rent payment due for July. If the amount of the waiver exceeds that payment, the balance of the waiver will be applied against the rent due for August and will not be paid to you in cash.
(e) For these purposes, the amount of the rent waiver will be calculated by multiplying the monthly Rent stated in the tenancy agreement by 12 (months), divided by 52 (weeks), multiplied by 2 (weeks).
(f) This 2 week rent waiver promotion offer is a "one off" offer. No tenant will be eligible to benefit from a 2 week rent waiver more than once.
(g) No tenant will be eligible to benefit from both the 2 week rent waiver and a welcome voucher under the Referral Scheme, whether at the same time or on a separate occasion. No tenant will be eligible to benefit from the rent waiver and any other discount concession or offer (except for the Rent Credit under the Referral Scheme if applicable). No tenant will be eligible to benefit from the rent waiver multiple times, even if under different tenancies or with different joint tenants.
(h) The tenant must be a new tenant and must not already be, or have been, in occupation of any premises let or owned by the Offeror or an associated company.
(i) The process to apply for the rent waiver is set out at paragraph 5 below.
3. The Promotion Period
3.1 The Promotion Package will be open during the period specified in the relevant marketing materials.
3.2 The Offeror may close or suspend the Promotion Package early at its sole discretion. Any such closure or suspension shall not affect any valid claims under the Promotion Package that have been submitted to the Offeror before that date.
4. Changes to the Promotion Package
4.1 The Offeror may change or withdraw any part of the Promotion Package, including the amounts offered and the period during which the Promotion Package applies, but only: (a) for a valid reason (for example, where a change is needed to comply with the law, to correct a mistake, or to reflect a change in circumstances beyond the Offeror’s control); and (b) after giving the Offeree at least 14 days' written notice, together with a clear explanation of what is changing and why.
4.2 The Offeror will tell the Offeree in writing about any changes to the Promotion Package or these terms and conditions, and will update the marketing materials to reflect those changes. Changes will only take effect as set out in clause 4.1.
5. Application for the Promotion Package
5.1 Rent waiver (paragraph 2.2)
(a) A rent waiver will not be applied automatically. The Offeree must apply for the rent waiver by submitting a request by email to Leasing@themaplenw2.co.uk before the start of the term of their tenancy.
(b) The Offeror is not responsible for any requests that are lost, misplaced, damaged or not delivered, unless this was caused by the Offeror or someone acting on its behalf.
6. The Tenancy Agreement
6.1 The Promotion Package is provided by the Offeror at its absolute discretion and operates separately from the tenancy agreement.
6.2 The Promotion Package shall not constitute a variation, or in any way affect the terms, of the tenancy agreement entered into by the Offeror and the Offeree, the terms of which shall continue in full force and effect.
6.3 For the avoidance of doubt, the Promotion Package shall not be treated in any way as reducing or changing the sums payable, including the Rent, by the Offeree under the tenancy agreement.
7. General Exclusions
7.1 The Promotion Package will not apply in the following circumstances (each an "Exclusion"):
(a) Where the Offeror has reasonable reason to believe that the Offeree is in breach of its tenancy agreement, including but not limited to the non-payment of rent;
(b) Where the Offeror has reasonable reason to believe that the Offeree is in breach of these Promotion Package Terms and Conditions;
(c) Where the Offeree is under 18 years of age;
(d) Where the Offeree is not accepted for a tenancy agreement including without limitation because the Offeree has not satisfied Right to Rent checks;
(e) Where the Offeree has vacated and / or given notice to terminate the tenancy agreement. Nothing in these terms restricts or penalises the Offeree's statutory right to end the tenancy in accordance with the Renters' Rights Act 2025 and the Housing Act 1988 (as amended).
7.2 If an Exclusion applies, the Offeror may revoke and stop applying the Promotion Package from that point onwards.
7.3 For the avoidance of doubt, where the Offeree comprises multiple tenants, the Promotion Package will not apply if an Exclusion is met by one or more of those tenants.
8. Data Protection
8.1 The personal information about the Offeree that is processed in relation to the Promotion Package will be managed in accordance with all applicable data protection and privacy legislation in force from time to time in the UK. For further information regarding the Offeror's processing of personal information, please refer to the Offeror's privacy statement here https://www.themaplenw2.com/privacypolicy.
9. Limitation of Liability
9.1 The Offeror and its associated companies will not be responsible for any loss or damage the Offeree suffers as a result of the Promotion Package, unless that loss or damage was caused by the Offeror's negligence, a breach of contract by the Offeror, or the deliberate wrongdoing of the Offeror or its staff. Nothing in these terms removes or limits the Offeror's responsibility for death or personal injury caused by its negligence, or any other responsibility that the law does not allow to be removed or limited.
10. General
10.1 These terms and conditions set out the full agreement between the Offeror and the Offeree about the Promotion Package. However, the Offeror will accept responsibility for any statements made by its staff before these terms were agreed, and where the Offeree reasonably relied on those statements.
10.2 By accepting any item within the Promotion Package, the Offeree agrees to be subject to these Promotion Package Terms and Conditions.
10.3 The Promotion Package shall apply to tenancy agreements entered into, or to be entered into, by individual tenants only and shall not apply to corporate entities.
10.4 The Promotion Package is subject to availability of selected apartments at The Maple only which have been identified by the Offeror as eligible for the Promotion Package at the time of reservation and shall be applicable on a first come first served basis based on successful reservation of the relevant apartment.
10.5 If there is a dispute about the Promotion Package or these terms and conditions, the Offeree should raise it with the Offeror. The Offeror will consider what the Offeree has to say and will reply in writing, explaining its decision and the reasons for it. If the Offeree is not happy with the Offeror’s response, the Offeree may refer the matter to an independent third party, or may take any other action available to them under the law.
10.6 The Offeree shall direct any queries it may have in relation to the Promotion Package or the Promotion Package Terms and Conditions to the relevant marketing / sales team for the property.
10.7 The Promotion Package is not transferable to other tenancy agreements or individuals.
10.8 No cash or other alternatives to the Promotion Package shall be offered.
10.9 The Promotion Package cannot be redeemed in connection with any other offer or promotion unless expressly specified otherwise in paragraph 2. The Promotion Package will not apply to apartments which are already subject to another rental discount, concession or promotional rent at the point of reservation.
